What We Are (and Aren't)

We are a marketing and technology platform. We are NOT a licensed insurance agent, broker, or insurance company. We do not sell insurance, underwrite policies, or make coverage decisions. Network Partners are independent licensed insurance professionals.

No Guarantee of Quotes: Submitting a quote request does not guarantee you will receive quotes or insurance coverage. Insurance companies make independent decisions about offering quotes based on their eligibility criteria, underwriting guidelines, and risk assessment. We cannot guarantee the number, quality, or pricing of quotes you may receive.

Eligibility

You must be at least 18 years old and a U.S. resident to use our Services. You are responsible for maintaining the security of your account credentials and for all activity under your account. Services may not be available in all states.

User Responsibilities

You agree to:

  • Provide accurate and truthful information in quote requests
  • Not submit false, misleading, or fraudulent information
  • Not misuse, scrape, crawl, or interfere with the Services
  • Not use the Services for any unlawful purpose
  • Keep your account credentials secure
  • Not train AI/ML models on our content without prior written consent

We may remove content, suspend access, or terminate accounts for violations of these Terms.

Call Recording Notice

Telephone calls with InsuranceBest and our Network Partners may be monitored and recorded for quality assurance, training, compliance, and fraud prevention. By remaining on a call after this notice or by proceeding with your quote request, you consent to such recording. Recordings are retained as long as reasonably necessary for business and legal purposes, typically 4-7 years or as required by applicable law. If you do not wish to be recorded, you may disconnect and contact us via email at support@insurancebest.com.

Your Express Written Consent

By providing your telephone number and clicking "Get My Quote," "Submit," "I Agree," or any similar button, you provide your prior express written consent under the Telephone Consumer Protection Act (TCPA) and state telemarketing laws, agreeing to be contacted for MARKETING and TELEMARKETING purposes.

Who Will Contact You:

  • InsuranceBest and our affiliated companies, AND
  • Multiple insurance companies, insurance agents, insurance brokers, and other Network Partners
  • We may share your information with 3-10+ companies, and each may contact you independently

Methods of Contact May Include:

  • Live telephone calls from agents
  • Prerecorded voice messages or artificial voice messages
  • SMS text messages
  • Calls made using an automatic telephone dialing system (ATDS/autodialer)
  • Any combination of the above methods

Where We May Contact You:

  • Contact may be made to the telephone number you provided, even if that number is on a federal Do-Not-Call list or a state Do-Not-Call list
  • You may receive calls and texts from multiple companies based on your single submission
  • Standard message and data rates from your wireless carrier may apply

IMPORTANT: Your consent is NOT REQUIRED as a condition of purchasing insurance or receiving an insurance quote.

How to Receive Quotes WITHOUT Providing Telephone Consent:

  • Call us at: (877) 707-7271
  • Email us at: quotes@insurancebest.com
  • Submit a quote request marked "Email Contact Only"

You may revoke your consent to receive marketing calls and texts at any time using ANY REASONABLE MANNER, including but not limited to:

  • Replying STOP to any text message
  • Calling our toll-free number at (877) 707-7271 and requesting to opt out
  • Emailing privacy@insurancebest.com with "Revoke TCPA Consent" in the subject line and your phone number
  • Informing any agent during a call that you wish to opt out
  • Any other reasonable method of communication

What Happens When You Revoke:

  • We will process your revocation request within 10 business days of receipt
  • We will immediately add your number to our internal Do-Not-Call suppression list
  • We will notify all Network Partners who received your information within the past 12 months of your revocation
  • We maintain records of all revocation requests and partner notifications for at least 4 years
  • You can request a list of partners who received your information by emailing privacy@insurancebest.com

Important Distinctions:

  • Revoking marketing consent stops marketing/promotional calls and texts
  • You may still receive informational messages about services you requested (appointment confirmations, policy updates) unless you separately opt out
  • Network Partners are independent businesses. While we notify them of your revocation, if you continue receiving calls after 30 days, contact the partner directly or file a complaint with the FTC

SMS/Text Message Program

By opting in to receive SMS messages, you agree to receive automated text messages from InsuranceBest and Network Partners at the mobile number you provided.

Message Frequency: From InsuranceBest: Up to 15 messages per month. From Network Partners: Varies by partner; each partner maintains separate SMS programs with their own frequency.

Opt-Out: Reply STOP to any message. You will receive a confirmation and no further SMS from that sender unless you re-opt in. Note: Each sender maintains a separate list – reply STOP to each sender separately.

Message & Data Rates: Standard messaging rates from your wireless carrier will apply to each message sent and received. Contact your carrier for details on your messaging plan.

Supported Carriers: Major U.S. carriers supported. Carriers are not liable for delayed or undelivered messages.

Intellectual Property

The Services and all content are owned by InsuranceBest and its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

DMCA Notices: If you believe content infringes your copyright, email legal@insurancebest.com with: (a) identification of the copyrighted work; (b) location (URL) of allegedly infringing material; (c) your contact information; (d) a good-faith statement of unauthorized use; and (e) a statement under penalty of perjury that you are authorized to act.

Electronic Communications Consent (E-Sign)

By using our Services, you consent to receive legally required disclosures and other information electronically (via email, website links, or your account). Electronic records have the same legal effect as paper records. You may print or download copies for your records.

System Requirements: To access electronic communications, you need: (1) Internet access; (2) Current web browser (Chrome, Firefox, Safari, Edge); (3) PDF reader; (4) Valid email address; (5) Ability to save/print documents.

To withdraw consent or update your email address, contact support@insurancebest.com. Withdrawal may limit your ability to use the Services.

No Warranties

The Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee accuracy, availability, or that the Services will meet your needs or that quotes will result in coverage.

Limitation of Liability

To the fullest extent permitted by law, InsuranceBest and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business, even if advised of the possibility. Our total liability for any claim will not exceed the greater of $500 or the amount you paid us in the 12 months preceding the claim.

Indemnification

You agree to defend, indemnify, and hold harmless InsuranceBest and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of: (a) your use of the Services; (b) your violation of these Terms; (c) information you submit; or (d) your violation of any third-party rights.

Dispute Resolution: Binding Arbitration

Arbitration Agreement: You and InsuranceBest agree to resolve disputes through individual binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. Either party may seek relief in small-claims court or for injunctive relief to protect intellectual property or prevent unauthorized access.

Class Action and Jury Waiver: You waive the right to participate in class, collective, consolidated, or representative actions or proceedings. You also waive the right to a jury trial. Relief in arbitration is limited to the individual party.

Opt-Out of Changes: If we change this Arbitration section, you may reject the change by emailing legal@insurancebest.com within 30 days. Prior agreements to arbitrate remain in force.

Severability: If any part of this section is found unenforceable, it will be severed and the remainder enforced. This section survives termination.

Termination and Changes

We may modify or discontinue the Services or these Terms at any time. Material changes will be posted and, where required by law, we will provide notice. Your continued use after changes constitutes acceptance. We may suspend or terminate your access for violations of these Terms.

Governing Law and Venue

These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles. Any arbitration or court proceeding will be conducted in Sheridan County, Wyoming.

Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect.
